Turns out Justice O'Connor's resignation is effective when the Senate confirms her successor. So I guess she is going to serve out the lifetime appointment after all . . . .
Lifetime? They're going to be wheeling out an urn of ashes with a black robe draped over it at the rate the Senate is going. As near as I can tell, William Renquist is kept moving by clever use of the Animate Dead spell.
